How can I protect myself if I move in with someone, or if I plan to marry or re-marry?
We can assist you by drafting documents that will protect your interests if you move in with someone or if you plan to get married or re-married.
Entering into a cohabitation relationship may have implications relating to support and property. If you live with another person for more than three years and you have established a relationship of interdependence, that person may make a claim against you for support even if you are not married. The right to make this claim may also arise if you live with someone for less than three years, but have a child together during that time. In the right circumstances, and in the absence of a contract that provides otherwise, a former partner could also successfully advance a claim to your property. Entering into a Cohabitation Agreement can help limit your exposure to such claims.
If you are considering marriage or remarriage, you may wish to enter into a Pre-Nuptial Agreement to address issues such as division of property upon dissolution of the marriage.
At Weizman Law, we can prepare these documents for your and/or provide you with the required independent legal advice to enter into a Cohabitation or Pre-Nuptial Agreement.
